Sole trader Riboldi Zamak, VAT number 01935160984, established in Via delle Orchidee 22 Moniga d / G (BS) – 25080, as Data Controller (hereinafter “Riboldi Zamak” or “Data Controller”) considers the privacy and the protection of Personal Data one of the main objectives of its activity.
This document has been drawn up pursuant to art. 13 of the EU Regulation 2016/679 ( hereinafter “Regulation”) as an instrument of information and training about our Privacy Policy; We therefore invite you, before communicating any personal data to the Data Controller, to carefully read this Privacy Policy as important information on the protection of your personal data are contained.
The current Privacy Policy:
– is understood as referring to the website www.riboldizamak.it ( hereinafter “the Site”);
– is an integral part of the Site and the services provided;
– is provided pursuant to art. 13 of the Regulation to to those who interact with the web services of the Site.
Your personal data processing will be based on principles of correctness, lawfulness, transparency, limitation of purposes and conservation, minimization and accuracy, integrity and confidentiality, as well as the principle of responsibility pursuant to art. 5 of the Regulation. Your personal data will therefore be processed according to the legislative provisions of the Regulation and the confidentiality obligations provided for therein.

The data controller is Riboldi Zamak, as defined above.
2. The personal data being undergoing processing
We inform you that, during browsing, Riboldi Zamak will process personal data that may consist of an identifier such as a name, an identification number, an ID or one or more characteristic elements of physical, physiological, mental and economic, cultural or social identity suitable to make the interested subject identified or identifiable (hereinafter only “Personal Data”).
Here are the Personal Data processed through the Site:
a. Browsing data
The computer systems and software procedures used to operate the Site acquire, during their normal operation, some Personal Data whose transmission is implicit in the use of Internet communication protocols. It concerns information that is not collected to be associated with specific individuals, but by their own very nature could, through the processing and association with data held by third parties, allow users to be identified.
This category of data includes IP addresses or domain names of computers used by users who connect to the site, URI addresses (Uniform Resource Identifier) of requested resources, the time of the request, the method utilized to submit the request to the server, the size of the file obtained in reply, the numerical code indicating the status of the response from the server (successful outcome, error, etc..) and other parameters related to the operating system and the users.
This data is used only to obtain anonymous statistical information on the Site and to check its correct functioning , to allow – given the architecture of the systems used – the correct provision of services, for reasons of security and assessment of responsibility in the event of hypothetical computer crimes against the Site or third parties. Data is usually deleted after sixty days.
b. Data supplied voluntarily by the user
The Website grants users the opportunity to voluntarily provide Personal Data, for example by filling in a contact form, by requesting services or information, by freely choosing to explicitly and voluntary send e-mails to the addresses indicated on the Website, etc. This Privacy Policy is also intended for the processing of Personal Data voluntarily provided through the Site.
c. Third-party data voluntarily provided by the user
When using some services of the Site, a processing of third-parties Personal data supplied by you to Riboldi Zamak may occur. In this case, you are an independent Data Controller and you assume all legal obligations and responsibilities. In this case, you therefore fully indemnify us against any complaint, claim, request for damages in consequence of the processing, etc. that we might receive from third parties whose Personal Data is processed through the functions of the Site, in violation of the applicable personal data protection laws.
In any case, if you provide or otherwise process Personal Data of third parties while using the Site, you guarantee from now – by assuming all related responsibilities – that this particular processing hypothesis is based on an appropriate legal basis according to the art. 6 of the Regulation (Lawfulness of the processing) which legitimizes the processing of such Personal Data.
3. Purposes and methods of processing
Your Personal Data will be processed, with your consent if necessary, for the following purposes, if applicable:
a. allow the provision of the requested services (such as, for example: contact request, a “Demo” or a quote, subscription to a Newsletter, request for information or enrolment in training courses, request to send documentation or permission to download it from the Site, reporting of misconducts, accessing the reserved area), browsing the Site;
b. finding specific request to Riboldi Zamak;
c. carry out marketing activities, such as compiling statistics and market research, sending you information and promotional material concerning Riboldi Zamak activities, products and services.
According to the provision of the Guarantor Authority for the protection of Personal Data “Guidelines on Marketing and against Spam – 4 July 2013 – 4 July 2013 [2542348]”, if you decide to give your consent to receive information related to Data Controller’s promotional activities , including market research, we inform you that such activities may be exercised, as required by the current regulations, by means of paper mail, telephone (“traditional methods”), e-mail, sending text messages and use of social networks (“automated methods”). We also inform you that you can decide, at any time, to revoke the consent previously issued by traditional or automated means, by communicating it to the Data Controller, without any formality, by writing to info@riboldizamak.it. If, in any case, you want to object to the processing of your Data for the purposes of marketing carried out using the means indicated herein, you may do so, at any time, by contacting the Data Controller by writing an email to info@riboldizamak.it, without affecting the lawfulness of the processing, based on consent given before revocation;
d. create user profiles, analysing all preferences, habits, interests and choices expressed through the use of the Site and the services offered, and, if necessary, with the use of profiling cookies, in order to be able to send you material and commercial communications and personalised promotions on all Riboldi Zamak services (“profiling”);
e. implement any obligations required by applicable laws, regulations or EU legislation, or any other requests from the authorities;
f. statistical purposes, without the possibility to trace your identity;
g. carry out direct marketing via e-mail for products and services similar to those of your interest (including: demo, material or documentation that can be downloaded from the Site), unless your express refusal to receive such communications, which you may express when requesting services or on subsequent occasions by sending an email to info@riboldizamak.it
h. Riboldi Zamak will also use personal data for administrative and accounting purposes and for the execution of contractual obligations towards users which form part of its customers.
Personal data provided through service or products registration form can be processed by Riboldi Zamak by using automated tools. Riboldi Zamak has the possibility to process such data in aggregate form, in compliance with the measures prescribed by the Guarantor Authority and by virtue of the specific exemption from the consent provided by the same, for analysis and electronic processing (e.g. classification of the entire clientele through homogeneous categories for service, consumption and expenditure levels, etc.) aimed at periodically monitoring the development and economic performance of Riboldi Zamak activities, controlling and improving the related industrial and commercial processes, services and designing and implementing commercial communication campaigns.
We adopt specific security measures designed to prevent loss, non-authorised processing and illicit or improper use of Personal Data.
The processing of Personal Data provided by users may also be carried out by companies, consortia and other bodies appointed as Data Controllers according to art. 28 of the aforementioned EU Regulation, which, on behalf of Riboldi Zamak, provide specific processing services, or related, instrumental or support activities.
4. Legal basis and mandatory or optional nature of data processing
The legal basis for the processing of Personal Data for the purposes referred to in section 3.a. and 3.b. is the art. 6 (1) (b) of the Regulation (“[…] the processing is necessary for the performance of a contract to which the data subject is party or to take steps at the request of the data subject, prior to entering into a contract”), as the processing is necessary for the provision of services or to respond to demands by the interested party.
The provision of Personal Data for these purposes is optional but failure to provide such data would make it impossible the proper functioning of the services requested or to fully meet your requests.
The processing carried out for the marketing purposes referred to in section 3.c is based on the release of your consent according to art. 6(1) (“the data subject’s consent to the processing of his personal data for specified purposes”) which might be collected through specific check-boxes or through the cookie banner, or on the legitimate interest of Riboldi Zamak according to art. 6 (1) (f) (“[…] processing is necessary for the purposes of the legitimate interests pursued by the Data Controller”). The provision of your Personal Data for these purposes is therefore optional and does not affect the use of the services. If you want to object to the processing of your personal data for marketing and profiling purposes, you may do so, at any time, by writing an email to info@riboldizamak.it.
The processing of your Personal Data referred to in section 3.e. represents a legitimate processing of personal data according to art. 6 (1) (c) of the Regulation (“[…] processing is necessary for compliance with a legal obligation to which the Data Controller is subject”).
It should be noted that the processing referred to in section 3.f. it is not executed on Personal Data and therefore can be freely performed by Riboldi Zamak.
The processing of your personal data for the purpose referred to in section 3.g. represents a legitimate processing according to the applicable legislation in force concerning the protection of Personal Data, which does not require your consent. You may object to the processing of your Personal Data for this purpose, both while requesting the products and services available on the site or during any other prior or later communication by the Data Controller, by writing to info@riboldizamak.it.
5. Recipients of Personal Data
Your Personal Data may be shared, for the purposes referred to in section 3 above, with:
a. subjects that operate as Data Controllers: i) persons, companies, associations or professional studies providing services or assistance and consultancy activities to Riboldi Zamak in administrative and legal matters, concerning the provision of services; ii) subjects with which it is necessary to interact for the provision of services (for example hosting providers, including OVH, which operates as Data Processor) or subjects delegated to perform technical maintenance activities (including maintenance of the network devices and electronic communication networks); collectively known as “Recipients”;
b. subjects, entities or authorities to which it is mandatory to communicate your Personal Data pursuant to legal provisions or orders from the authorities or in the case of reporting of misconducts to investigate complaints and identify the source of messages received from users;
c. persons authorized by Riboldi Zamak to process the Data to carry out activities strictly related to the provision of services; such persons are committed to confidentiality or have an adequate legal obligation of confidentiality (e.g. Riboldi Zamak employees);
d. trade partners, only after you have given your specific consent.
6. Transfer of Personal Data
The Data Controller won’t transfer your Personal Data outside the European Economic Area.
Personal data is recorded and stored on electronic databases located in Italy, in countries belonging to the European Economic Area (EEA) which guarantee an adequate level of data protection.
7. Storage of Personal Data
The Personal Data processed for the purpose referred to in section 3.a. and 3.b. will be kept for the time strictly necessary to achieve those purposes. In any case, since these are processing carried out for the services provision, Riboldi Zamak will process the Personal Data up to the time allowed by the Italian legislation, to protect its own interests (Art. 2946 of the Civil Code and subsequent amendments).
Personal Data processed for the purposes referred to in Section 3.c. and 3.d. will be processed until your consent is revoked.
Personal Data processed for the purposes referred to in Section 3.e will be stored for the period of time envisaged by the applicable laws.
Personal Data processed for the purposes referred to in Section 3.g will be processed until your opposition to such processing

In any case, the possibility for Riboldi Zamak to keep his Personal Data for the time allowed and admitted by Italian law for the protection of his interests (Article 2947 (1) (3) of the Civil Code) is reserved.
8. Rights of the interested party
According to the art. 7 of the Privacy Code and art. 13 GDPR the user has the right to obtain from the Company as controller of the data processing the confirmation of the existence or not of Personal Data concerning him, even if not yet registered, and its communication in intelligible form.
The interested party has the right to ask Riboldi Zamak about:
- the source of the personal data;
- the purposes and methods of processing;
- the logic applied when the data is processed with the use of electronic instruments;
- the identity of Data Controller, Data Supervisors and of the representative designated;
- the parties or categories of parties to which the personal data can be transferred or which could learn of them as designated representatives of the State, processing officers, or processors.
According to articles 15 and following of the Regulation, you also have the right to ask Riboldi Zamak, at any time, to access your Personal Data, to rectify or cancel them or to object to their processing according to art. 21 of the Regulation; you also have the right to request the restrinction of the processing in the cases provided for by art. 18 of the Regulation and to obtain your data in a structured and commonly used electronic format, according to art. 20 of the Regulation.

You are always entitled to lodge a complaint with the competent Control Authority (Guarantor for the Protection of Personal Data), according to art. 77 of the Regulation, if you consider that the processing of your Personal Data is contrary to the legislation in force.

The Data Controller may modify or simply update this site Privacy Policy, in part or completely, even owing to variations of the laws and regulations that govern this matter and protect your rights.

The Riboldi Zamak website collects information that may refer to the user and his preferences, or the Internet access device (computer, tablet or mobile phone), and is mainly used to adapt the site operation to the user’s expectations, providing a better browsing experience and sending customised promotional messages.
